Melbourne Wine Racks (MWR’s) is committed to its Customers in delivering a prompt professional service. By purchasing from MWR’s you agree to the following Terms and Conditions.
Authorisation to Proceed
By checking out with a completed order (contact information and valid payment details), we deem this to be authorisation to proceed.
Ability to Supply
Any obligation of MWR’s to supply Goods and Services is subject to its ability to secure labour, products and some external services for supply and delivery. From time to time we may be out of stock and in such circumstances the customer will be advised using their preferred method of communication. No payment will be made until we confirm our ability to supply within a mutually agreed time.
Whilst its our intention to send Goods out within 3 - 4 business days, MWR’s shall not be liable in any way for failure to deliver the Goods and/or supply of services within the stated time and the Customer shall accept and pay for the Goods and Services not withstanding any such failure to deliver within the stated time.
MWR’s will have no liability to the Customer in relation to any loss, damage or expense caused by MWR’s failure to complete the order or to deliver the goods as a result of fire, flood, tempest, earthquake, riot, civil disturbance, theft, crime, strike, lockout, breakdown, war, the inability of MWR’s suppliers to supply necessary materials or any other matter beyond MWR’s control.
Pickup / Delivery
Customers can pickup their online orders from our showroom saving freight costs. At checkout select “Pick up”. We will contact you advising of when your order is ready. We don’t insure goods from the time they leave our premises. Customers may arrange their own insurance and courier service with pickup from our Brunswick West Showroom.
Australia Parcel post is our preferred delivery method and as such is governed by a strict set of service levels as outlined on their website, www.auspost.com.au Such service levels vary depending on postcode location. Whilst being our preferred supplier we may from time to time use other couriers.
Delivery of Goods shall be deemed to occur when they are delivered to the Customer or his/her nominated representative as per Australia Post’s delivery guidelines and the Goods shall thereafter be at the Customer’s risk.
Upon the signing of a delivery docket, unless the contrary is noted in that docket, the Goods shall be deemed to have been delivered in good order and condition.
Guarantee / Warranty
All Goods are checked for any faults or defects prior to being packed and dispatched to the Customer.
We will replace or repair Goods found to be genuinely faulty. Please report any problem within 7 days of receipt. No returned products will be accepted without prior authorisation, a receipt (proof of purchase) and Goods as supplied, in original condition.
All Goods come with a manufacturer warranty which varies from product to product. We reserve the right to repair or replace according to location and the circumstances and/or the severity of the failure or damage that have caused any claim to be made. Warranty does not cover products that have been damaged or modified in any way during assembly or installation, or that have been incorrectly assembled, installed or applied. Photos may be requested in such circumstances to be provided to the manufacturer.
Timbers used are natural materials, subject to variations in colour, grain structure and strength and any such variations are not accepted as valid warranty or refund claims.
Difficulty in assembling or installing a product is not accepted as a warranty or refund claim unless caused by faulty components.
Notwithstanding any other provisions of these Terms and Conditions, MWR’s is in no circumstance (whatever the cause) liable in contract, tort (including without limitation, negligence or breach of statutory duty) or otherwise to compensate the client for:
- any increased costs or expenses,
- any loss of profit, revenue, business, contracts or anticipated savings,
- any loss or expense resulting from a claim by a third party, or
- any special, indirect or consequential loss or damage of any nature whatsoever caused by MWR’s delay to complete or delay in completing the service or to deliver the Goods.
These Terms and Conditions shall be construed according to the laws of Victoria and it shall be deemed that the appointment of MWR has been made in the state of Victoria, Australia.
Orders will be processed within 3 – 4 business days of receiving them. Any variation to this service will be brought to the attention of the customer for approval.
Payment can be made via:
- Cash (in-store only)
- Credit card (Visa, Master Card and American Express)
For credit card purchases via telephone, Customers are reminded to ensure the card number, expiration date and name on the card are correct. CREDIT CARD DETAILS ARE NOT STORED IN OUR SYSTEM
Orders are only processed once payment has been confirmed.
All prices are quoted in Australian Dollars and include 10% Goods and Services Tax (GST). Prices and availability are subject to change without notice. Availability will be corrected on the site where discovered in error and MWR’s will advise the customer of any such change.
MWR’s endeavours to depict as accurately as possible all goods for sale on its site. Photos and colours can be perceived / depicted differently on different devices and by different people. Products may also vary slightly between different manufacturing runs due to a slight variation in the processes used, colour variations may occur. Timbers used are natural materials, subject to variations in colour, grain structure and strength. We regret this is beyond our control. Such variations do not constitute a claim, refund or exchange by the customer.
Returns will only be accepted by prior arrangement. MWR’s does not give refunds if the customer simply changes their mind or makes a wrong decision in their product selection. Title to the Goods to be delivered will not pass to the Customer until MWR’s has received payment in full, per the Order/Contract.
Variations made to an order once approved may incur additional charges. Any additional charges to be incurred will be brought to the attention of the Customer and approved by the Customer prior to the variation being accepted.
